Terms Of Service.
Overview;
This website is operated by Ruth Fiona Floral (RFF). Throughout the site, the terms “we”, “us” and “our” refer to RFF. We offer this website, including all information, products and services to you, the “User”, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
Binding Terms;
By visiting our site and/or paying a deposit towards your wedding or event, you engage in our “Service” and agree to be bound by the following terms and conditions. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use our Service.
Changes to Website;
We are permitted to modify the contents of this site at any time, but we also have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.
Use of Images & Photography;
We may take photos of the flowers prior to the event and may use these for social media content. If you are happy to share professional photos of your special day, please email them through to HELLO@RUTHFIONAFLORAL.COM.
Any professional photos shared with RFF may be used in social media content, website content or otherwise. Please let us know if you have specific limitations to the use of these images - We appreciate it is your special day so feel free to discuss this with us.
Flower Substitution Policy;
Where specific varieties of flowers are defined, RFF reserves the right to make substitutions of flowers of equivalent value and variety whenever market condition, weather, or availability affect the integrity of the flowers in our proposal.
If there is a particular flower you would not like substituted, please make this clear during the consultation.
Our Wedding Policy;
All weddings and events require a non-refundable deposit/ booking fee which will go towards your final balance. Payment of this deposit/ booking fee means you have agreed to our Terms of Service. The acceptance of the Terms of Service and deposits paid guarantees the date is booked. The precise content of the proposal with regard to colour, floral variety, and creative direction, remain a fluid collaboration between RFF and the client up until 3 months prior to the date of event.
The balance is due and payable in full 4 weeks prior to the date of the event. Changes to quantities in an order must be made at least 4 weeks before delivery and changes to colour palette/ concept need to be made at least 3 months before event date.
RFF will begin to place orders for the product needed for your wedding or event once your quote is accepted. In the event of cancellation, all payments already made are non-refundable.
All rented or borrowed equipment will be collected and inventoried by RFF post event. A charge will be made for any equipment that is damaged or lost based upon the retail cost. All vase-ware, props and accessories remain the property of RFF (unless otherwise stated in writing) and must not be taken off site from the venue without the prior written consent from RFF.
Our Styling Policy;
Specialising in flowers and event styling, clients must ensure that no added styling elements are added without RFF knowing and agreeing to these additions. RFF does not favour DIY elements to be mixed within wedding or event briefs, as this dilutes RFF’s brand and is a conflict of interest.
We understand that this can sometimes occur due to a cost concern. So please make sure you have that conversation with us very early on so we can guide you accordingly. We want your special day to have all the elements you dreamt of!
Edits;
Confirmation of all floral items should be made no less than 30 days prior to the wedding. However, reasonable additions can be made up to the day of the event but must be paid within 5 days.
Cancellation/Postponements;
A booking can be cancelled up to 4 weeks before the event date with the deposit forfeited. Any client cancellation occurring within 4 weeks of the event date will be refunded at 50% of the total invoice.
In the case of an event date being rescheduled or postponed, the deposit paid can be used towards any future booking.
Bump In;
A senior florist from RFF will always be on-site on the day of the event.During the event setup, our team has creative authority over all floral directions unless the client has previously authorised another person or team agreed upon by both parties.
Additional hours spent by our team on location performing tasks that were not listed in the invoice will be invoiced after the event at a rate of $85 per hour per person.
We make every effort to ensure that we deliver the florals agreed upon. If however, there is an unforeseen disappointment or mishap with the flowers, please make contact within 7 days of the event.
We will investigate the issue and proceed with the appropriate action to rectify the problem.
Force Majeure;
For purposes of the present terms of service, "Event of Force Majeure" means any event or events which RFF cannot provide their service, despite all reasonable efforts - which include but not limited to war, terrorism, riots, civil strife, lightning, fires, explosions, storms, floods, other acts of nature, strikes, lockouts or acts of authorities preventing RFF from fulfilling their obligations. If RFF is prevented from performing any of its obligations by reason of an Event of Force Majeure, RFF shall be excused from their commitments. RFF will discuss and come to a reasonable compromise after the Event of Force Majeure.
